Alleged  sack of ANLCA NECOM:  We are yet to get court order – Nwabunike

The National Executive Committee (NECOM) of the Association of Nigerian Licensed Customs Agents (ANLCA) has discredited reports that members of the executive council of the association have been sacked by a Federal High Court in Lagos.

Speaking with journalists in Lagos on Wednesday, members of the national executives, comprising of the National President, Hon. Tony Iju, Vice president, Kayode Farinto and the  National Secretary-General, Mukaila Azeez in a joint press parley said that they were yet to receive any court order to the effect.

 The National President said that the two plaintiffs, Olumide Fakanlu and John Nwagbaraocha were ineligible to sue the association because they ceased to be members of ANLCA since 2018.

Nwabunike told journalists that the duo are not financial members of the association, hence their ineligibility to sue the association or any of the members, let alone sacking the executives.

 “I saw on a platform some court injunctions that one John Nwagbaraocha and Olumide Fakanlu with a court proceeding that before 9th of September, 2020, we should come and let them know why we should continue and that was not an order and was on a platform that does not belong to us.

“We are here waiting, believing that a bailiff will bring such things and if he brings it, we will send it to our legal department, we have about five lawyers.

“If what I saw is true, what it means is that the two people that went to court, are not eligible to be members of this association.

“Since I became the President of this association, i have not seen John Nwagbaraocha or Fakanlu Olumide paying the annual subscription that makes them eligible to become members of this association.

“If that is true, I consider the court action null and void even before going to court because an outsider cannot come and take an institution to court without being a proper member of that place.”, declared Nwabunke.

Also speaking, the National Secretary of the association, Mukaila Azeez said that the plaintiffs erred in law in relation with the constitution of the association.

He said that the association’s constitution is the one that guides the actions of the members of the group and that it is binding on all members.

He maintained that those that approached the court for redress over issues in the association have violated the constitution.

Quoting section 26 (2) of the constitution of ANLCA, Azeez said the constitution has provided that all disputes be directed to arbitration before heading to the court
